While using the American College Foundation (“ACF”) website, your privacy is important to us.  We recognize your need for appropriate protection and management of any personal information you share with us.  To assist you, we provide this Privacy Statement explaining our online information practices and the choices you can make about the way your information may be managed.

This Privacy Statement applies to all personal information entered through our ACF website.  Personal information is data that reasonably can be used to identify or describe an individual.

ACF uses the personal information you enter to provide relevant content and personalize your experience.  Please be advised that all college costs and funding estimates are projections only.  Each school’s admission and funding administrators have the final say on all awarded funding.

ACF keeps ALL personal information confidential.  We will not sell, rent or lease ANY information to others who are not directly affiliated with ACF.

To protect against unauthorized access, disclosure, or alteration of personal information, ACF employs appropriate physical, technical, and administrative measures.

Extensive physical security is designed to prevent unauthorized access to database equipment.  High-level electronic security measures, such as firewalls, access restrictions, and encryption provide protection from hacking and unauthorized access.  ACF limits access to personal information to those persons in the ACF organization, or as agents of ACF, who have a specific business purpose for maintaining and processing personal data.

By using the ACF website, you signify your agreement to the terms and conditions of this Privacy Statement.  If you do not agree to these terms and conditions, please do not disclose any personal information to the ACF website.

If we change this statement, we will post the revised statement here, along with the date of revision.  If we make significant changes to the statement, we may also post a notice on our home page. Any changes will apply only from date of the revision.  Amended dispute resolution provisions will not apply to any dispute of which the parties had actual notice as of the date of the amendment.

By accessing / using the American College Foundation (“ACF”) website, you hereby agree to the following Terms of Use:

Personal Use

The ACF authorizes you to access / view, as a single copy, the content available within the ACF website solely for your personal, noncommercial use. All contents of this website are protected under United States copyright, trademark, and other applicable laws.

All contents and materials used, provided, and displayed are the sole possession of the ACF. Under these Terms of Use you agree not to modify, reproduce, retransmit, distribute, disseminate, sell, publish, broadcast, or circulate any such material or any version of any material, in part or in whole, without the advanced written permission of the ACF.

The ACF website may be used only for lawful purposes by individuals seeking information about colleges, universities, financial aid, or private sector scholarships.

ACF Visionary Scholarship

When registering for the ACF Visionary Scholarship or when requesting additional information pertaining directly to the college planning process, you will be asked to provide valid contact information, including, but not limited to, address, city, state, zip, phone, and email address. The ACF will NOT release this information to any unaffiliated third-party service, except to the extent necessary to comply with applicable laws or in legal proceedings where such information is relevant.

When applying for and submitting your subsequent ACF Visionary Scholarship ‘Application Packet’ you understand and agree that your submitted application packet becomes the exclusives property of the ACF and that no correspondence regarding the receipt, screening, verification, or judging status of a submitted application packet will be accepted. By applying for the ACF Visionary Scholarship, you are certifying that neither you (the student) nor your family (parents, stepparents, and/or guardians) are NOT an employee of the ACF, their subsidiaries, affiliates, advertising and/or promotion agencies. You also understand that an application packet may NOT be amended or supplemented once it has been received. Winners will be selected and notified accordingly, with funds distributed directly to the institution during the month of July prior to the applicable funding year. If you are awarded the ACF Visionary Scholarship while an underclassman, the monies will be held by the ACF until you complete high school and/or high school equivalent and begin your higher education. If you are selected as a recipient of the ACF Visionary Scholarship, you agree to have your name, award-winning essay, state of residence, and photo used by the ACF in publicizing awards.

Expressed Written Consent

At the time of your data submission, and IF you elect to receive additional information regarding colleges, universities, college planning and/or college funding resources, procedures, and associated strategies from the ACF and approved affiliates of the ACF by checking the “I / we would like to receive additional resource information updates from colleges, universities, the ACF, and any ACF approved affiliate.” box, you are agreeing to the following: YOU HEREBY EXPRESSLEY CONSENT TO THE AMERICAN COLLEGE FOUNDATION AND ITS AFFILIATES SENDING OR OTHERWISE COMMUNICATING WITH YOU FOR ANY PURPOSE (INCLUDING, WITHOUT LIMITATION, FOR INFORMATIONAL, ADVERTISING, MARKETING, OR PROMOTIONAL PURPOSES, OR FOR SENDING OR NOTIFYING YOU about updated scholarship availability, newly announced scholarship winners, college preparation, college funding, college planning strategies, college cost-related reports, special offers, other necessary updates, newsletters, and/or other informational purposes) via any electronic means or forms the ACF deems appropriate in its sole discretion, whether through the ACF website, through the ACF App, through your ACF User Account, by personal communication, by email, by telephone, by online social media, by short message service, and multimedia messaging service or by other electronic media or forms. By giving such consent, you agree that no such communication shall violate the TCPA, the CAN-SPAM Act or any other applicable laws, rules, or regulations. Voice, message, and data fees, rates, charges and/or taxes may apply to you, and you are responsible for payment of the same. You ARE NOT required to grant the foregoing consent as a condition of applying for the ACF Visionary Scholarship and/or accessing all ‘free’ content contained within the ACF website. You may withdraw this Expressed Written Consent at any time by sending an email to: operations@americancollegefoundation.org. Please include Withdraw Expressed Written Consent in the Subject Line, along with the name(s), phone(s), and email(s) to be withdrawn.

Website Usage Disclaimer

The ACF does not warrant that the ACF website will operate error-free or that the ACF website and its server(s) are free of computer viruses or any other related harmful mechanisms. In the event any equipment or data repair or replacement is necessary because of accessing the ACF website, the ACF is NOT responsible for any costs associated with the repair and/or replacement; the aggregate liability of the ACF to you for “all” claims arising from the use of the ACF website shall not exceed twenty-five dollars ($25).

The ACF website contains links that are provided “solely” as a courtesy to you and in no way should be construed as an endorsement or solicitation for business. The ACF is not responsible for the content of any linked (third-party) website and makes no representations regarding the content, accuracy, validity, or usefulness of any such linked site.

The ACF website is explicitly designed as a “venue” only; the ACF is not involved in the actual transaction, business or otherwise, between colleges, financial aid providers, students, third-party companies, or any employees thereof.
